1. Company and Website Identity
Prominent Contact Limited, trading as InFynd (“InFynd”, “we”, “us” or “our”), is committed to responsible, transparent and lawful electronic communications.
This Anti-Spam Policy applies to email marketing, promotional communications and other electronic commercial messages sent by or on behalf of InFynd in connection with our website, products and services.
We respect the privacy, preferences and communication choices of recipients. Our aim is to ensure that our marketing activities are relevant, responsible and consistent with applicable anti-spam and data protection requirements.
2. Prohibition of Unsolicited Email Advertising
InFynd strictly prohibits advertising or promoting infynd.com, its products or its services through unsolicited bulk email.
We do not authorise the use of unsolicited bulk email campaigns to advertise our business, generate leads, promote our services or direct recipients to our website.
We also prohibit employees, contractors, marketing agencies, affiliates and other service providers acting on our behalf from conducting such activities.
We do not permit our brand, website, email domains or business identity to be used in connection with deceptive, misleading or unauthorised email marketing.
Any suspected violation of this policy will be reviewed and appropriate corrective action will be taken.
3. Email Marketing Practices
All email marketing conducted by or on behalf of InFynd must comply with applicable laws, regulations and our internal marketing standards.
Consent and lawful contact
We will send marketing communications only where we have the required consent or another valid legal basis permitted by applicable law. We will assess the relevant requirements based on the recipient’s location, the type of recipient and the nature of the communication.
Where consent is required, it must be obtained before marketing messages are sent. We will maintain appropriate records of consent and other relevant permissions or legal-basis assessments.
Mailing lists and data sources
We will use mailing lists responsibly and take reasonable steps to ensure that contact information is appropriate for the intended communication.
We prohibit the use of lists obtained through unlawful means, deceptive practices or unauthorised access. We will not knowingly use contact data in a manner that violates applicable privacy, data protection or electronic marketing laws.
Where third-party data or marketing lists are used, their suitability and lawful use must be assessed before a campaign is launched.
Sender identification and transparency
Marketing emails must accurately identify the sender and must not use misleading sender names, deceptive subject lines or falsified routing information.
Messages must provide sufficient information for recipients to understand who is contacting them and why. Where required by applicable law, they must also include the sender’s valid contact details and relevant business identification.
Unsubscribe requests and suppression
Marketing emails must provide a clear and accessible way for recipients to unsubscribe or opt out of future marketing communications.
We will process unsubscribe requests promptly and within the timeframe required by applicable law. Recipients who opt out will be added to the relevant suppression records to prevent further marketing messages of the same type, subject to limited communications necessary to administer their preferences or comply with legal obligations.
We will not require recipients to provide unnecessary information or pay a fee to unsubscribe.
Campaign monitoring
We may review campaign activity, complaints, delivery indicators, unsubscribe rates and other relevant signals to identify potential policy violations.
Where concerns arise, we may pause campaigns, suspend access to marketing systems, investigate the source of the activity or take other appropriate corrective action.
4. Third-Party Marketing Providers
Any marketing agency, contractor, affiliate, data provider or other service provider acting for or on behalf of InFynd must comply with this Anti-Spam Policy and all applicable laws.
Third-party providers must:
- Use contact data only for authorised and documented purposes.
- Obtain and maintain required consent or establish another applicable legal basis before sending marketing communications.
- Use accurate sender identification and transparent messaging.
- Honour unsubscribe requests and applicable suppression lists.
- Protect personal data and prevent unauthorised use or disclosure.
- Maintain appropriate records and cooperate with compliance investigations.
- Refrain from sending unsolicited bulk email advertising or promoting InFynd.
InFynd may investigate suspected non-compliance and suspend campaigns, restrict access, terminate relevant service arrangements or take other appropriate action where a violation is identified.
Engaging a third party does not remove our responsibility to take reasonable steps to oversee marketing activities conducted on our behalf.
